Refer a Business terms and conditions

The terms and conditions that apply to Three’s Refer a Business promotion are set out below.
 
1. The Promoter is Hutchison 3G UK Limited of 450 Longwater Avenue, Green Park, Reading, Berkshire RG2 6GF (“Three”) in cooperation with Aklamio GmbH, Hauptstraße 27-29, Haus 9 (Neubau) Aufgang N, 10827 Berlin (“Aklamio”). Aklamio is a vendor who facilitates referral marketing services.
 
2. The Refer a Business Promotion (“Promotion”) will run from 1 September 2022 until 30 April 2026, but may be withdrawn, amended or extended, at any time and without notice (“Promotion Period”). If the Promotion is withdrawn, any cash payment due as a result of a Qualifying Purchase (see below) pursuant to a referral will be honoured.
 
3. To be eligible for participation in the Promotion, you must be a resident in the UK and be 18 years or over.
 
4. Any business referred for the Promotion must be a valid Business based in the UK or, where the Business is a sole trader, the sole trader must be aged 18 or over and a UK resident (“Business Friend”).
 
5. If you are an employee of Three or Aklamio you may enter this Promotion only in your personal capacity. Any entries that we (Three or Aklamio) reasonably believe were submitted during, or in furtherance of, the course of your employment will be deemed ineligible and will be disqualified.
 
6. If you are a Business, any reward codes received from a parent company, subsidiaries and or affiliated companies of your Business will be deemed ineligible and will be disqualified.  You are permitted to refer a Business Friend if such Business Friend is also your employer.
 
7. You cannot refer any Business Friend if you are a Business, or an employee of a Business, already engaged as a representative of Three and receiving commission from Three under a separate arrangement.
 
8. You and the Business Friend cannot be the same person. Where Three identifies they are the same person, for example by email address, phone number, or account name, the offer or entry will be void or disqualified. This includes referring your own franchise or franchisee.
 
9. A Business Friend cannot be an existing customer of Three.
 
10. Your Business Friend may be a previous Three Business customer (with all agreements or plans with Three now terminated) subject to these Terms and Conditions, and further, subject to having a full payment history and no instances of abuse or fraud identified whilst previously being a Three Business customer and not having had an agreement with Three terminated for any reason whatsoever.
 
11. There is no limit to the number of Businesses you can refer in Three’s Promotion.
 
12. Maximum reward: The total maximum Cash Reward for Three Business product(s) and/service(s) per Qualifying Purchase is capped at £2,500 (shared at £1,250 each between referrer and Business Friend) regardless of number/type of product(s) and/service(s) purchased by a Business Friend.
 
13. To enter the Promotion, you must either follow the referral journey on Three’s website, https://www.three.co.uk/business/refer-a-business or you can call our Three Business Team or visit one of our Three Stores where a customer advisor will commence the referral journey on your behalf. You will be required to provide your email address so Aklamio can send the Referral Link (defined below). You will also be required to accept these Terms and Conditions together with Aklamio’s General Terms and Conditions for Users and Privacy Policy. Aklamio use ReCAPTCHA to protect their portal from attack. ReCAPTCHA is subject to Google’s Terms of Service, and Google’s privacy policy. Once you agree to Aklamio’s terms and conditions, a contractual relationship will be established between yourself and Aklamio to which Three is not a party and over which Three does not have control.
 
14. You agree by referring a Business Friend to our services and products through sharing your Referral Link with them, that you have consent from them to do so. You further agree that you shall not submit any content:

a.     that is known by you to be false, inaccurate or misleading;

b.     that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

c.     that violates any law, statute, ordinance or regulation (including, but not limited to, those governing consumer protection, unfair competition, anti-discrimination or false advertising);

d.     that is, or may reasonably be considered to be, defamatory, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any person or entity;

e.     for which you were compensated or granted any consideration by any third party;

f.      that includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or

g.     that contains any computer viruses, worms or other potentially damaging computer programs or files.

15. Having completed the referral journey (whether online, via the Three Business Team or in-store), you will be sent a unique referral link (“Referral Link”) to the email address you provided which you may share by email to any Business Friend.

16. To successfully accept a referral, your Business Friend must:

a.     receive a Referral Link and click on the Referral Link to obtain a reward code;

b.     visit a Three retail store or call the Three Business Team on 0800 0338022 and provide the reward code. Purchases cannot be made online;

a.     successfully enter into an agreement with Three for qualifying Three Business product(s) and/service(s)  included within the Promotion, and such other offers as Three may make available from time to time as set out in the Categories table on https://www.three.co.uk/business/refer-a-business (“Qualifying Purchase”);

b.     comply with Three’s Terms and Conditions for using the Three Network for Business customers, including paying their first three bills in respect of the Qualifying Purchase in full and on time, available at https://www.three.co.uk/terms-conditions/business-terms-and-conditions.

c.     be a Business and enter into a Three Business Agreement in respect of the Qualifying Purchase as a Business wholly or mainly for use in connection with their trade, business, craft or profession, even if they are an individual

d.     Remain connected for the Returns Period in respect of the Qualifying Purchase.

Referral attempts that do not use the unique Referral Link mechanism, or do not provide the unique reward code obtained via the Referral Link to the Three retail store or when calling the Three Business Team to purchase an eligible Three Business Plan, will not qualify for the Cash Reward. The reward code must be provided at the time of purchase to be eligible for the Promotion and cannot be provided retrospectively. The reward code can be used one time only and will expire when used by the Business Friend for a Qualifying Purchase.

17. If a Business Friend satisfies the requirements set out within these terms, as determined by Three in its sole discretion, you will receive, within 3 months, a cash award associated with the Qualifying Purchase(s) purchased by your Business Friend (“Cash Reward”). You will be able to redeem the Cash Reward in your dashboard within the Refer a Business page at https://www.three.co.uk/business/refer-a-business subject to having registered for the Aklamio services and having agreed to Aklamio’s General Terms and Conditions for Users.  Each Business Friend may use your Referral Link (and thus reward code) once only to make a Qualifying Purchase (but may continue to participate in the Promotion by requesting their own Referral Link to share and use in accordance with these Terms and Conditions).

18. The Promotion is not available in conjunction with any other promotional offer or via any other purchase route than those set out in these Terms and Conditions, including offers on third party websites.

19. The Cash Rewards (or any part thereof) are not transferable by either yourself or your Business Friend and no alternative will be offered. Three reserves the right at any time to substitute an alternative prize of similar or greater value. The Cash Rewards may be subject to additional terms and conditions. Recipients of the Cash Rewards agree that the cost of and the responsibility for complying with such additional terms and conditions will be borne solely by them, and that all third-party terms and conditions relating to the Cash Rewards are beyond Three’s control. Cash Rewards are inclusive of VAT.

20. At Three’s sole discretion, Three reserves the right to disqualify any entries:

a.     that contravene the spirit or the applicability conditions of the Promotion including those set out in these terms and conditions;

b.     if the Three Business agreement for the Business Friend is declined or terminated by Three (for whatever reason) including but not limited to breach of applicable laws or regulations, unsatisfactory credit checks, non-payment of any invoices due under the newly entered Three Business Agreement, or a sanctions check necessitating termination of the agreement entered into by the Business Friend;

c.     if you are a Business and providing the Cash Rewards to you would be in breach of applicable laws including sanctions; or

d.     if Three have identified any fraud and security risks with accepting the Referral Link or entries received.

and any Cash Rewards must be returned immediately in the case of such disqualification.

21. Three reserves the right to withdraw the Promotion if, in Three’s judgement, the offer is being abused. Three also reserves the right to change or amend the reward and the structure of the offer at any time. Any decision made by Three with regards to this offer is final. Any Referral Links or rewards codes not used shall no longer be eligible for the Promotion in the event of withdrawal of the Promotion.

22. Referrals will only be eligible if all applicability conditions have been met as set out, and the Business Friend is not already an existing Customer with Three or in conversation with Three already via any other channel, about receiving Three Services.

23. Three does not guarantee that the Cash Reward value between generation of Referral Link and Qualifying Purchase shall remain the same. Business Friend will be eligible for the current Three Business products and/or services, and the Cash Reward will be as per the current Promotion at the point of purchase.

24. The Cash Reward will become available as soon as reasonably practicable following, and subject to these terms and:

a.      the Business Friend paying their first three bills in respect of the Qualifying Purchase, in full and on time;

b.     the Qualifying Purchase remaining connected during the Returns Period; and

c.     Business Friend not being subject to any collections activity and/or sanctions or fraud investigations

You and your Business Friend, as applicable, will be notified via email by Aklamio once the Cash Reward is available. Please review and comply with Aklamio’s instructions on how to redeem the Cash Award in the Aklamio’s General Terms and Conditions for Users, which are outside of Three’s control.

25. Cash rewards are only payable in respect of a Qualifying Purchase(s) set out within the initial Three Business Agreement for each Business Friend referred. New lines, plans, products or Services (whether by new Referral Link, new reward code or otherwise and whether by a new Three Business Agreement or otherwise) shall not be eligible for any further Cash Rewards by either you or your Business Friend notwithstanding that these additional lines, plans, products or Services may be included within the Categories table set out at https://www.three.co.uk/business/refer-a-business.

26. Three cannot accept responsibility for entries lost or delayed in transmission. Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the Promotion, redemption process, subscription or account with Aklamio, performance or non-performance by Aklamio, or any prize connected with the  Promotion and it excludes liability, to the fullest extent permitted by law for any loss or damage caused to the participants arising out of the  Promotion or any part thereof.

27. Entry into the Promotion signifies your acceptance of these Terms and Conditions. Three also reserve the right to amend these Terms and Conditions at any time without notice. 

28. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and subject to the exclusive jurisdiction of the courts of England and Wales.

29. Definitions: Business means an organisation or enterprising entity engaged in commercial, industrial, or professional activities. Businesses can be for-profit entities or non-profit organisations. Business types range from limited liability companies to sole proprietorships, corporations, and partnerships.
