Apple Subscription: Cashback Promotion Terms and Conditions (the “Promotion”)

1.           Promoter: This Promotion is organized and administered by Hutchison 3G UK Limited of 450 Longwater Avenue, Green Park, Reading, Berks RG2 6GF, trading as Three (“Three” or “We”).

2.           Dates: This Promotion will commence on 19/04/2024 and will close at 23:59 on 19/05/2024 the “Promotion Period”).

3.           Eligibility: This Promotion is open to any Three customer who is 18+ and a UK resident, who:

a.       is (or becomes, during the Promotion Period) a registered account holder on an Apple IOS device (iPad, iPod Touch or iPhone) (“Apple IOS Device”), operated by APPLE (UK) LIMITED, company number 01591116 (“Apple”);

b.       does not have a recurring Apple subscription prior to the start of the Promotion Period; and

c.       pays for Apple App Store content via their Three mobile phone account linked to the Apple IOS Device as the approved payment method,

(“Eligible Customer”).

4.           The Offer:  We are offering a refund to your Three mobile account  of up to a maximum of £5 for one transaction to each Eligible Customer who purchases an Apple IOS subscription via the Apple IOS App Store (“App Store”) (“Cashback Offer”).  The Cashback Offer is limited to one per Eligible Customer. This Cashback Offer is non-transferable and non-exchangeable. There will be no substitutes and no cash alternatives. 

5.           The Rules:  To accept this Cashback Offer, you must be an Eligible Customer and purchase an Apple IOS subscription via the App Store during the Promotion Period. The Apple IOS subscription content cost (“Subscription Content Cost”) may be to any value, but only the first £5 of it will be refunded under this Cashback Offer.  For example:

If the Subscription Content Cost is under £5.00, then only the value of that content will be refunded, and you will not be entitled to any further credit (see examples above).  Three reserves the right to refuse the Cashback Offer to any person impersonating an Eligible Customer or any Eligible Customer who, Three, in its absolute discretion, considers is acting against the spirit of this Promotion.

6.           Refunds: The relevant amount, up to a maximum of £5, will be refunded to an Eligible Customer’s Three mobile account on the bill following the end of the 1st month’s Apple IOS subscription.  An Eligible Customer’s bill cycle will be unchanged.  No refunds will be made once outside the Promotion Period or to anyone who is not an Eligible Customers.

6.           General:

6.1         NOTE ON SUBSCRIPTIONS:  Apple IOS subscriptions continue indefinitely, and you will be charged ongoing fees automatically on a regular basis until cancelled.  The ongoing fees, billing frequency and how to cancel vary from subscription to subscription and Apple will explain these before you make a purchase of one of their subscription services.  The relevant subscription fees will show on your Three mobile phone bill each month. You must cancel your subscription before the end of the current billing period otherwise you will be charged the subscription fees for the next period.  See: Subscriptions and Billing - Official Apple Support for terms and info on subscriptions.

6.4         Three cannot and does not accept responsibility for Promotion entries lost, corrupted or delayed in transmission. Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in this Promotion, the Cashback Offer, or the redemption or refund process for the Cashback Offer and Three excludes liability, to the fullest extent permitted by law for any loss or damage caused to the recipients of such items. 

6.5         Any third-party terms and conditions relating to this Promotion are beyond the control of Three. Each Eligible Entrant agrees that the cost of and the responsibility for complying with such terms and conditions will be borne solely by them.

6.6         Three reserves the right, acting reasonably and in accordance with all relevant legislation and code of practice, to vary the terms and conditions of the Promotion (including, without limitation, to cancel, modify or supersede the Promotion (including altering the Cashback Offer) by changing these terms and conditions. No correspondence will be entered into by Three.

6.7         Entry into this Promotion signifies acceptance of these terms and conditions, which are governed by English law.
