That new phone feeling Social Media Prize Draw Terms & Conditions – September 2021

These terms and conditions are the rules which apply to this Prize Draw. By submitting an entry, entrants will be deemed to have agreed to be bound by them.

Promoter

1. That new phone feeling (“Prize Draw”) is organised by Hutchison 3G UK Limited, trading as Three, of Great Brighams Mead,1 Vastern Road, Reading, Berkshire RG1 8DJ (“Three” or “We”). The Prize (as defined at paragraph 6 below) is administered and provided by Three.

Dates

2. The Prize Draw opens on 24.09.2021 at 08:00 and closes on 26.09.2021 at 23:59 (“Promotion Period”).

Eligibility

3. To be eligible to enter the Prize Draw entrants must:

• be over 18 years of age,
• be a UK resident (excluding Northern Ireland),
• have a non-private Instagram account (otherwise we won’t receive your entry), and
• purchase a 24 month pay-monthly contract with handset during the Promotion Period (“Eligible Purchase”) in one of the following Three retail stores: Glasgow Braehead, Stratford Westfield, Cardiff St David’s, Sheffield Meadowhall, Brixton, Liverpool 2, Oxford St 297, Plymouth Drake circus, Edinburgh Fort, Wood Green (“Participating Stores”) and retain their proof of purchase;

(“Eligible Entrants”).

Entrants may be required to provide photographic ID to prove their eligibility. This Prize Draw is not open to employees of Three, its agents, contractors, consultants, or anyone professionally connected with the Prize Draw.

Entry

4. To enter the Prize Draw, Eligible Entrants must post a photo taken using the “New Phone Feeling” frame in Participating Stores (or another photo) during the Promotion Period after their Eligible Purchase to their non-private Instagram feed, using #LifeNeedsaNewPhone and tag @threeuk during the Promotion Period (“Qualifying Entries”). Personal details including name and Instagram handle will be captured.

Rules

5. The following rules shall also apply to the Prize Draw:

a. Only one Qualifying Entry per Eligible Entrant on Instagram will be considered by Three and entered into the Prize Draw. Entries in excess of this limit will render all entries made by that person void.

b. If posting a photo taken by or showing another person, the Eligible Entrant must make sure they have that person’s permission to submit the photo for the Prize Draw.

c. Late entries will not be taken into consideration in winner selection.

d. Each entrant warrants that all information submitted by them is true, accurate and complete and Three is not responsible for any information which is invalid or incomplete.

e. Three reserves the right to exclude and/or disqualify any entry which it deems, in its sole and absolute discretion: (i) to be offensive or inappropriate; (ii) fails to comply with these terms and conditions; and/or (iii) to be contrary to the spirit or intention of the Prize Draw.

Prize

6. One winner will receive a £200 Love2Shop voucher (“Prize”). Only one Prize per winner will be awarded. Prize allocation remains at Three’s sole and absolute discretion.

Selection of winner

7. The winner will be randomly selected by a computer process, under independent supervision, from all Qualifying Entries on 27.09.2021. The decision will be final and Three will not enter into any correspondence. 

Contacting the winners

8. Reasonable efforts will be made by Three to contact the winner of the Prize via direct message to the Instagram account used to enter the Prize Draw by 27.09.2021 17:30. Eligible Entrants should ensure their Instagram settings enable Three to contact them in this way and check their Instagram direct messages between 27.09.2021 and 28.09.2021 and Three shall not be responsible in the event a winner does not claim the Prize because they have failed to do so. If the winner of the Prize cannot be successfully contacted, does not claim the Prize within 72 hours of notification (by responding to Three), or is unable to comply with these terms and conditions, Three reserves the right to offer the relevant Prize to another Eligible Entrant (who will be selected in the same manner described in paragraph 7). Failure to respond or failure to meet the eligibility requirements may result in forfeiture of the Prize.

Redeeming the Prize

9. The winner of the Prize will be required to provide a valid email address to receive their Prize, proof of an Eligible Purchase in a Participating Store and their full name and county. The winner may also be required to submit additional valid identification before receiving the Prize. Acceptable forms of identification and proof of purchase remain at Three’s sole and absolute discretion. If the winner is not able to provide the proof of an Eligible Purchase in a Participating Store (or is otherwise not an Eligible Entrant or has otherwise not complied with these terms and conditions), their entry will be disqualified, they will not be entitled to the Prize and Three reserves the right to offer the relevant Prize to another Eligible Entrant (who will be selected in the same manner described in paragraph 7). The winner warrants that all information submitted by them is true, accurate and complete and Three is not responsible for any information which is invalid or incomplete, including any contact details. Three shall use reasonable endeavours, subject to these terms and conditions, to fulfil the Prize as soon as reasonably possible after the winner has claimed it and confirmed their correct details and email address.

Privacy

10. Any personal data collected by Three in connection with this Prize Draw will be used to administer and fulfil this Prize Draw. Information that entrants supply when entering the Prize Draw will be used only in accordance with Three’s Privacy Policy and these terms. Our use of such information will also be subject to our Privacy Notice contained in section 13 of the Terms and Conditions governing the use of Three’s Services. 11. The winner of the Prize will be asked when they are contacted by Three (as described in paragraph 8) whether they consent to their first name and entry being used in any Three marketing activity across some or all media channels.

12. The surname and county of the winner can be obtained by sending an email to studiothree@three.co.uk within 30 days after the date of the closing date of the Prize Draw. If you object to this information being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

General

13. The Prize is not transferable or exchangeable. No cash alternatives will be offered. Three reserves the right at any time to substitute the Prize for an alternative prize of similar or greater value where circumstances beyond our control makes it necessary to do so. Further, we reserve the right to amend these terms and conditions (including altering the Prize) at any time without notice by updating these terms and conditions and publishing them at www.three.co.uk/terms-conditions. No communications will be entered into by Three regarding this. An Eligible Purchase from a Participating Store is necessary to enter this Prize Draw.

14. This Prize Draw is in no way endorsed by, sponsored by, associated with or administered by any third parties (including Instagram & Apple)

15. All third party terms and conditions relating to the Prize Draw or the Prize itself are beyond our control. Three cannot accept responsibility and will not be liable for any failures to abide by any or all third-party terms applicable to the Prize.

16. Three cannot accept responsibility for entries lost, corrupted, or delayed in transmission or for the failure by any winner to check their direct messages and/or emails (including junk folder). Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the Prize Draw or the Prize (or any aspects of them), and Three excludes liability, to the fullest extent permitted by law, for any loss or damage caused to a winner of the Prize arising out of or connected to the Prize or this Prize Draw. Statutory rights are not affected.

17. Entry into the Prize Draw signifies your acceptance of these terms and conditions. These terms are governed by English law.
