1.1. These terms and conditions of use (the “Terms”) set out how you may use our loyalty rewards programme offered via the Three+ applications available on iOS, Android, and EMUI and the Three+ website (“Three+”). By accessing and using Three+ you are deemed to accept these Terms (and the standard Three terms) and confirm that you accept and agree to comply with them. Please read them carefully and if you do not accept them, please do not register for or use Three+. You can deregister from Three+ without cost at any time in the “Settings” section of the Three+ app.
1.2. Three+ is operated by Hutchison 3G UK Limited (“we”, “us” or “Three”). We are registered in England and Wales under company number 03885486 and have our registered office at 450 Longwater Avenue, Green Park, Reading, Berkshire, RG2 6GF. When we say “you”, “your” or “customer” we mean you, our customer, who is using Three+.
1.3. We may update and change Three+ or these Terms from time to time. Your continued use of Three+ will be deemed to be acceptance of the amended Terms which will be updated here with a new date. These terms were last updated on 21 March 2022.
2. What is Three+?
Three+ provides Three with a platform to offer eligible registered Three+ customers (“Members”) with certain rewards, offers, and content, which may include prize draws and competitions from time to time (collectively “Rewards”) including from selected third party brand partners ("Brand(s)") subject to the Terms herein. Three+ is an optional loyalty programme provided by Three without charge to its Members and it does not form part of any airtime contract you may have with Three and can be withdrawn or amended at any time in accordance with paragraph 7.2 below.
3. Who is eligible?
3.1. To become a member, you must be a Three customer who:
(i) has a Pay Monthly account or a Pay As You Go voice (“PAYG”) account (including both account holders and their dependants if the account holder has taken out an account on their behalf, provided they have the account holder’s permission) and this account is not of the type listed in clause 3.2.;
(ii) has a valid Three mobile number;
(iii) is based in the United Kingdom; and
(iv) is aged 18 or over on the date of registration for Three+.
3.2. Home Broadband, Mobile Broadband, and SMARTY customers are not currently eligible to use Three+.
3.3. If you are a Three PAYG customer, you may not be eligible to use the Rewards in Three+ if your PAYG account is not Active. “Active”, for the purposes of Three+, means that you must top up a minimum of £10 in each 90 day period.
3.4. If you are a customer through Three Business, you do not need to be the account holder to register, provided you have an active Three Business SIM and have permission from the account holder to register.
3.5. We have the right to disable or suspend your Three+ membership and/or access to the Rewards at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. This includes, without limit:
(i) If you leave Three (including terminating your contract, transferring ownership of your account to someone else, porting out your number to another telco provider or returning a device in your money back guarantee/refund window) your Three+ membership will be terminated. If you return to Three within 30 days then your Three+ membership can be reactivated. Transferring ownership or returning to Three after 30 days may affect your ability to register for Three+; and
(ii) If your bills are not paid up to date or we suspect fraud on your account or if you have a PAYG account and it is not Active, we reserve the right to suspend or terminate your access to Three+ and/or the Rewards.
4.1. The Rewards we make available as part of Three+ can only be selected and used in the ways described and cannot be used with any other offers, vouchers, or promotions, or be exchanged for cash or any other reward (unless stated otherwise). Some Rewards are provided by Three and others are provided by the Brands (“Brand Rewards”) but both are Rewards for the purposes of these Terms.
4.2. The Rewards made available to you as part of Three+ are subject to availability (including in some cases, whilst stocks last) and are regularly updated and changed. Additional terms and eligibility criteria apply to individual Rewards, this may include terms and conditions which Brands require you to agree to if you want to use a particular Brand Reward. You will have a limited period of time to use some of the Rewards provided to you and some of the Rewards can only be used on particular days or before specific dates. We do not make any commitments about how long any Rewards will remain open for and we will not be responsible if your request for a particular Reward is not received by us or a Brand. Some Rewards may require ID to be presented when redeeming (for example to verify age when redeeming an alcohol related Reward). Unless expressly stated otherwise for a specific Reward, Rewards are personal to you and should not be shared with anyone else. If a Reward is shareable, then a share option will be clearly presented on Three+. Please check specific Rewards terms and conditions for details on the availability, eligibility, and redemption rules which apply to the Rewards.
4.3. Unless otherwise stated for a specific Brand Reward, the Brands themselves are responsible to you for all aspects of their Brand Rewards offered on or via Three+ (including, without limitation, the administration, redemption, fulfilment, and purchase of any products or services) and you should deal with them if you have any questions or issues in relation to those specific Brand Reward terms and conditions. We are not responsible for any third-party products and services provided to you by Brands.
4.4. Three shall have sole discretion to decide whether to make certain Rewards available from time to time to Members on an individual, group, or collective basis.
5. Who to contact?
5.1. If you have any questions about these Terms, Three+, or the Rewards offered by us (but excluding the Brand Rewards), or require technical support relating to Three+, please see the FAQs section or contact us. You will need to be the account holder, or an authorised contact named on the account, for us to speak to you via our Contact Centre.
5.2. If you have any questions relating to the Brand Rewards displayed on Three+, please contact the relevant Brand, whose contact information will be included in the Brand Rewards terms and conditions.
6. Account registration and your data
6.1. You will be required to register for a Three+ account in order to become a Member and be eligible to access and redeem the Rewards. If you choose to register, you will be asked to provide certain personal information to us and to choose your marketing preferences. Our Privacy Notice sets out how we may use and retain that information and any other data that we collect about you as a result of using Three+. We are not responsible for the content or privacy practices of the Brands, and you should check their privacy notices before providing them with any personal information if redeeming a Brand Reward. You confirm to us that all information submitted by you is accurate and you agree that we have the right to verify your eligibility to use Three+.
6.2. You are responsible for keeping your login, password, and other security information confidential. You must not disclose it to any third party. If you have any concerns that someone has access to your login or password details, please Contact Us immediately.
6.3. You can change your personal information and marketing preferences you have provided to us during registration in the “Settings” section of Three+.
7. Access to Three+ and our liability to you
7.1. Three+ is made available by us to Members without charge and on a temporary basis. We do not guarantee that Three+ or the Rewards on it, will always be available or fault-free, or be uninterrupted and to the fullest extent allowed, any use is provided on an “as is” and an “as available” basis. You agree and accept that Three+ is for your own personal use and will not be used for commercial purposes. We will not be liable for any reason if Three+ is unavailable or restricted for any period.
7.2. We reserve the right to suspend, make any changes to, restrict, or discontinue Three+ all or any feature or part of Three+ without notice to you at any time.
7.3. Use of Three+ is at your own risk and the information made available on and through Three+ is not intended to amount to advice on which you should rely. We make no representations, warranties, or guarantees (express or implied) that the content (including the Rewards) made available on Three+ is accurate, complete, or up to date. For the avoidance of doubt, we disclaim all liability and responsibility arising from reliance of information in the Brand Rewards and content provided by the Brands. To the fullest extent permitted by law, we exclude all liability to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with Three+, the Rewards (including Brand Rewards), or any other third party content linked to or accessible from Three+. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, and for fraud or fraudulent misrepresentation.
7.4. If you receive a message from Three+ offering you to browse the internet or make a call, this usage may come out of any available data or voice allowance. If you do not have an available allowance for this usage to come out of, charges may apply (including roaming charges if accessed abroad). All charges will be in accordance with those set out in the Price Guide for your plan.
8. Acceptable use of Three+
8.1. You may use Three+ for lawful purposes only. You may not use Three+ in any way for any unlawful or fraudulent purpose or effect including in any way that breaches any applicable local, national, or international law or regulation.
8.2. You agree not to reproduce, duplicate, copy, or re-sell any part or parts of Three+, or Rewards advertised using Three+. You also agree not to access without authority, interfere with, damage, or disrupt any part of Three+, or any equipment or network or code or software used in the provision of Three+.
9. Trade marks, material and content
9.1. We are the owner or licensee of all copyright, database rights, patents, and other intellectual property rights in Three+ and in the material published on it. No license is granted to you regarding such rights, except to the extent required for your personal use of Three+ in accordance with these Terms.
9.2. You must not copy, reproduce, modify, post (including on social media sites), or otherwise use the content or materials (including the Rewards) displayed on Three+ or made accessible through Three+ in any way without our permission, and you must not use any illustrations, photographs, graphics, video, or audio sequences, except for your own personal, non-commercial use.
9.3. Three® and Three+™ (and any and all associated logos) are trade marks of Three. Brand trade marks are owned by the respective Brands. You are not permitted to use them without permission from us or the Brands (as applicable). You may not use any sign which is confusingly similar to our or the Brands’ trade marks, or which takes unfair advantage of, or is detrimental to, the distinctive character or the repute of our or the Brands’ trade marks. You are not permitted to use any identical or similar word(s) to Three+ as a domain name, sub-domain name, metatag, or bid for any identical or similar word(s) to Three+ in Google’s AdWords program (or any similar service available now or in the future).
10. Links from Three+
Where Three+ contains links to Brand sites or other sites, these links are provided for your information only. We do not approve, endorse, or control any linked websites, and we do not accept responsibility or liability for such links and their content or availability and reliability.
11. Jurisdiction and applicable law
These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. You and we both agree to the non-exclusive jurisdiction of the courts in England and Wales.
